These terms govern your use of Fairview Sites, a website builder operated by Fairview Software Inc. ("we", "us", "Fairview"). By creating an account or publishing a website with us, you agree to these terms.
Fairview Sites generates a website tailored to your industry from the business details you provide, hosts it, and lets you edit it from your dashboard. The service includes the platform, the published website, lead capture, and basic hosting on Cloudflare.
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your account. You must be authorized to act on behalf of the business you list.
You can cancel at any time from your dashboard. Your website remains live until the end of the current billing period, then is taken offline. We do not offer prorated refunds for the unused portion of a billing period.
You own the content you provide. We own the platform itself, including the underlying templates and generation system. We grant you a nonexclusive license to use the platform and the generated website for as long as your subscription is active.
You grant us the limited license necessary to host, display, and back up your content so we can provide the service.

We may suspend or terminate accounts that violate these rules. Severe or repeated violations may be reported to applicable authorities.
Domains you already own (connect your own). If you connect a domain you registered elsewhere, you remain its owner and are responsible for renewing it with your registrar. You authorize us to configure the DNS and certificate settings needed to serve your site on it.
Domains you buy through us. When you purchase a domain through Fairview, the domain is registered with you as the registrant and owner. We act as your service provider to register, configure DNS for, renew, and host the domain on your behalf, and we keep it in our Cloudflare account for operational management. You authorize us and our registrar (Cloudflare) to manage the domain for you. You are responsible for lawful use, for any trademark or naming rights, and for providing accurate registrant and contact information.
Renewals. A purchased domain is billed as a separate annual charge and stays active only while that charge is paid. If a renewal payment fails, we will retry for a short period and may disable automatic renewal. If it remains unpaid, we may stop serving the domain and allow the registration to lapse after notice to you.
Transferring away. You may request to transfer a domain you bought through us to another registrar at any time, and we will provide the authorization code needed to do so. Registry and registrar rules may restrict transfers, including a lock during roughly the first 60 days after registration or a registrant change. We may also decline a transfer while there is an unpaid balance on the domain.
We work to keep the service available, but we do not guarantee uninterrupted operation. We may perform scheduled maintenance and may experience outages at our upstream providers (Cloudflare, Stripe, Firebase) that are outside our direct control.
The service is provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or noninfringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, Fairview's total liability arising from these terms or your use of the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
You can close your account at any time. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the service or other customers. On termination, your published website is taken offline and your data is handled as described in our Privacy Policy.
We may update these terms from time to time. Material changes will be notified by email to active account holders at least 30 days before they take effect. Continuing to use the service after the effective date constitutes acceptance.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in that province, without regard to conflict of law principles. Disputes will be resolved in the courts of Alberta.
